Confidentiality of test results
Merial considers IGENITYTM Testing Service results to be confidential. Merial will, in good faith, provide test report results only to the individual purchaser (“Customer”) who submits the test samples and makes payment for testing services rendered. Merial will report test results to the Customer according to that Customer’s written instructions, as indicated by the Customer on the IGENITY Order Form. The completed IGENITY Sample and Order Forms should accompany all sample shipments to the IGENITY Testing Service.
Test report options include mail delivery, fax or email. Customers who do not indicate a preferred method of receiving test results will have their results report mailed to their billing address. Merial will make good faith efforts to assure confidential reporting channels to Customers, but will assume no liability for the inadvertent or deliberate interception of test results by outside parties.
Certification of livestock genotype
Merial will offer to Customers mechanisms to obtain certification of their tested animals’ genotype. These services will be available online at www.igenity.com. The Customer will be responsible for the accuracy and any liability arising from any representation made with respect to the certificates. Please report suspected abuse of certificates to 1-877-IGENITY.
Merial will from time to time offer Customers other voluntary opportunities to utilize test result publishing tools. These services, such as directories of livestock to be sold or to be purchased, will allow Customers, at their own discretion, to use test results to enhance their own marketing efforts. The Customer retains sole discretion whether or not to publish, in part or in whole, their test results. The Customer will assume sole responsibility for the accuracy and integrity of the published information, and will act in accord with policies developed to protect such services. Inasmuch that the test result reports can or will be used in transactions between the Customer and other third parties, the Customer remains solely liable for any use or misuse, deliberate or accidental, of his or her test data. Merial offers no warranty, expressed or implied, to vouch for the accuracy or truthfulness of any Customer’s representations about tested or untested livestock to any third party. Nor does Merial offer any such warranty to the third party or subsequent livestock owners in regards to use of IGENITY test results, certificates, customer support mechanisms, or similar services. Fraudulent or other misuse of IGENITY Testing Service programs shall be strictly prohibited.
Proprietary test result data
Test result forms and certificates issued to Customers are the property of the Customer paying for the tests. Results of all IGENITY testing done by Merial will be retained on a proprietary database owned by Merial. Merial reserves the right to keep and to manage this database for scientific and business information, as well as to publish aggregate studies and reports which do not disclose the confidentiality of individual customer records. Examples include, but are not limited to, such studies as: genotype frequency studies, livestock improvement surveys, management practice reports, etc. Merial will not willingly or knowingly disclose individual test results to any outside party without the expressed permission of the Customer.
Test result logo trademark protection
Merial has for the benefit of its customers developed a test result trademark system. Customers may utilize this trademark system as a part of their value-added relationship with IGENITY Testing Service to market BEEF cattle or semen from BEEF cattle of certified genotype. These trademarks may be used only on tested BEEF animals. These trademarks may not be used to identify the genotype of untested progeny of tested animals. These trademarks may not be used to market DAIRY bulls or semen from DAIRY bulls, without written permission from Merial. However, customers can utilize the trademark system to document the genotype of one or both parents in matings or pairings that have resulted in progeny. Customers using the trademark system must comply with Merial logo use guidelines and correct any deficiencies upon demand by Merial. Merial will not tolerate inaccurate or fraudulent use of the trademark system. Merial encourages its customers to read the IGENITY Logo Use Guidelines and understand the obligations and opportunities that use of the logos will provide. Any such misuse shall be strictly prohibited.
Confidentiality of your IGENITY Customer account profile
Merial will not in any case release Customer operational or account records to any third party. As a part of its ongoing support services, Merial may from time to time provide its Customers with promotional information about its products or services, and will periodically inform its Customers about management advisories relating to their operation or IGENITY test results. Customers at any time may decline to receive this information. For further information on our Privacy Policies, please read on.
Test report depiction
This report describes results of our analyses of the sample or samples of biological materials described herein above (i.e. blood/hair/semen). Merial warrants that it has applied its best efforts to the determination of the presence and identification of specific alleles of bovine genes in DNA from the samples identified herein that were provided to us by you. Merial provides no other warrant including, but not limited to, that any other allele is or is not present in any sample or in any animal. Results of analyses are predicated on the assumption that each sample was obtained from a single cattle beast. Results of analyses are reported herein in association with sample designations provided by you. We assume no responsibility for correctly identifying a particular animal as the source of any sample.
